Financial Impact

The proposed $390,000 expenditure is included within the approved Fiscal Year 2026-2027 Economic Development/Real Estate and Public Works Capital Improvement Program budgets and will be budgeted accordingly in subsequent fiscal years (Account Strings:

01369065-400201; 40536031-400201-23011). There is no impact on the General Fund.

Statement Of The Issue

City staff is requesting authorization to enter into a contract with NV5 Environmental, L.P. (NV5) for environmental work reporting at various locations in Marina Bay, as required by DTSC, for a not-to-exceed amount of $390,000.

Recommended Action

Discussion

NV5 Environmental, L.P. (NV5) has provided the Successor Agency and City with environmental analysis review and interface with regulatory agencies regarding soil conditions and soil handling for properties throughout Marina Bay, as required by Department of Toxic Substances Control (DTSC) (Attachment 2). City of Richmond requires similar environmental services for nine deed-restricted sites in Marina Bay including annual inspections and reporting. There will also be additional contract work as required by DTSC, such as the preparation of a five-year review work plan, Area T enhanced Groundwater and work with construction of the Area FM Temporary Cap.

Remediation and development services will be performed with an Area T Cap Maintenance Plan and environmental consultation services for the disposition of Area FM. NV5 will also provide environmental consultation services for Area T, perform annual inspections of nine deed restricted properties in Marina Bay and FM Temporary Cap work as designated in the CIP budget approved by City Council on June 29, 2021.

NV5 is the only firm able to provide continuity of services for the City of Richmond’s environmental work at the Marina Bay deed-restricted properties, which it has supported for approximately three years following its acquisition of the former firm PES (Attachment 2). NV5 has prepared environmental engineering reports for the affected sites and obtained concurrence from the California Department of Toxic Substances Control regarding the methodologies used to evaluate and address environmental conditions. Through this work, NV5 has developed specialized knowledge of the City’s environmental sites, regulatory history, technical data, and redevelopment requirements. Retaining NV5 will preserve continuity, avoid duplicating prior technical and regulatory work, and reduce the time and cost required for another consultant to become familiar with the sites and reestablish coordination with the California Department of Toxic Substances Control. This continuity is necessary to support the timely remediation and redevelopment of former Successor Agency properties in Marina Bay and other City-owned areas.

City staff recommends that the City Council approve a sole-source contract with NV5 Environmental, L.P. for environmental consulting services related to Area FM, Area T, and nine deed-restricted properties in Marina Bay.
